Terms & Conditions

The following terms and conditions govern all bookings made with Fortis Events. Accordingly, in requesting or purchasing packages you acknowledge that you have read and accepted these, and agree to be legally bound by them.

1. Making a Booking

  • 1.1You must be 18 years or older to book a package with Fortis Events.

  • 1.2If booking for more than one person, the person who makes the booking is the “booking coordinator”. They are responsible for:

    • Making full payment for the package(s), including any amendment charges.

    • Informing the group of all relevant details, as all documents and information regarding the booking will be sent to the booking coordinator.

  • 1.3We recommend you purchase travel insurance at the time of purchasing your Fortis Events package.

  • 1.4In booking a package with Fortis Events, the participant(s) acknowledge that they have read, understood, and accept these conditions.

2. Pricing and Payment

  • 2.1All prices are in New Zealand Dollars per person and include any applicable GST.

  • 2.2Accommodation is priced on a twin share or single occupancy basis.

  • 2.3Our contract with you begins upon receipt of full payment. After placing a booking, you will receive a confirmation of your booking and an invoice and/or receipt. These should be checked carefully and if any details are incorrect you need to inform us within five working days.

  • 2.4100% payment is due at the time of booking.

  • 2.5Pricing is based on payment by internet banking or cheque. Payment by credit card will incur a credit card service charge which is not included in the package price. A credit card service charge of 2.5% will be incurred for any payments made by Visa or Mastercard.

  • 2.6If we have not received payments within the timeframes outlined above, we reserve the right to cancel your booking.

  • 2.7Please note that for contractual reasons, our package pricing cannot be itemised. The package price only includes the services specified in your itinerary. Travel insurance an any personal incidental costs incurred during travel are excluded.

  • 2.8Each amendment made to the booking within 90 days of travel will incur an amendment fee of $100 per amendment per person, in addition to any fees charged by suppliers. No changes are permitted within 10 days of the travel date.

  • 2.9Prices are based on supplier costs, exchange rates, taxes, levies, and surcharges at the time of publication. Prices are subject to change due to currency fluctuations, inflation and/or increase in supplier costs and regulatory charges at any time until full payment is received. If we advise you that the package price has changed substantially pursuant to this clause 2.9, you have the right to cancel your booking in accordance with clause 3.6 and we will refund your deposit to you.

  • 2.10If you are booking a corporate incentive, Fortis Events will provide you with separate terms and conditions and payment terms pertaining to your booking.

3. Cancellation

  • 3.1The booking coordinator must advise Fortis Events of any cancellations in writing.

  • 3.2Except as provided under clauses 2.9 and 4.6, your payment will not be refunded to you if you cancel your booking for any reason at any time before the travel date.

  • 3.3Most of our arrangements with suppliers are non-refundable and we are under no obligation to pursue any of our suppliers for refunds.

  • 3.4Without limiting any other provision hereof, Fortis Events has no liability to make any refund whatsoever, if for any reasons outside the control of Fortis Events, the package is partly or wholly cancelled for any reason including bad weather. Fortis Events recommends that the you consider obtaining appropriate insurance cover. Should a facility or venue for an event for any reason be destroyed or made unusable Fortis Events is not obliged to make any refund.

  • 3.5Tickets or vouchers will be void if on sold, traded, scalped or used as a competition prize or for promotional purposes without written authority from Fortis Events.

  • 3.6Should you decide to cancel under clauses 2.9 or 4.6, you must exercise your right to do so within 14 days of the issue date printed on your revised invoice. On receipt of your notification that you wish to cancel, we will refund your payment to you and we will have no further liability to you.

  • 3.7Once your package services have commenced, refunds will not be provided where due to illness or personal choice you do not utilise part of or all of the package inclusions.

4. Changes by Fortis Events

  • 4.1Because packages are planned in advance, we may occasionally need to make changes to package inclusions. We reserve the right to make changes to your itinerary at any time. We will advise you of changes at the earliest possible date.

  • 4.2Some suppliers of the services included in your package reserve the right to cancel or amend the services they provide. Fortis Events will use reasonable endeavors to provide alternative services, however we cannot be held responsible for any such changes imposed by the supplier.

  • 4.3Prices and arrangements have been made based on minimum group sizes. Completion of the booking and payment process for the tour package is not confirmation that the package will proceed.

  • 4.4In the event that minimum numbers are not met, we reserve the right to impose a surcharge, amend itinerary events so that the event may proceed, and/or cancel the tour.

  • 4.5Should we choose to impose a surcharge, you will have the right to cancel in accordance with the provisions of clause 3.2. Should we choose to cancel the tour, you will be entitled to a full refund of the monies paid by you to us and we shall have no further liability to you.

  • 4.6All reasonable care has been taken to ensure the accuracy of information on the website and other published material - however, prices and services offered are subject to change.

5. Tickets

  • 5.1The tickets that form part of your package may not be resold or transferred without our prior written consent, and you cannot advertise or offer a ticket for transfer or resale on the internet or through any other medium. Tickets also cannot be used for advertising, promotion or other commercial purposes (including prizes, competitions or trade promotions) or to enhance the demand for other goods or services without the prior written permission of Fortis Events.

  • 5.2If we are made aware of any prohibited use of your tickets, we reserve the right to cancel your tickets.

  • 5.3If an event you are scheduled to attend is cancelled, we will refund you the face value of your ticket if we are able to obtain a refund from the ticket issuer. Your holiday package will be unaffected by the event cancellation and we will continue to provide you with the agreed services. We recommend you check your travel insurance to make sure that you are covered if an event you are due to attend is cancelled or postponed.

  • 5.4We will distribute your tickets to you in a manner that we deem most appropriate. We will let you know which method of distribution we intend to use before to departure, but reserve the right to amend this at any time. Once distributed tickets are your responsibility and cannot be replaced.

  • 5.5Please note that Fortis Events cannot be held responsible where the position or perceived quality of your seat at an event does not meet your personal expectations.

  • 5.6If you would like your ticket seating allocation to be with other customers travelling to the same event, please advise us during the booking process. While every effort will be made to allocate seats together, this will be dependent on the ticket allocations we receive and cannot be guaranteed.

6. Flights

  • 6.1Where flight-inclusive packages are promoted, special group airfares have been included in the package pricing. Where packages including group airfares are no longer available, we are happy to assist with adding a flight to an available package for an applicable booking fee.

  • 6.2As airlines reserve the right to alter schedules, Fortis Events cannot be held responsible when confirmed flights are subsequently changed or cancelled. Once issued, airline tickets are non-refundable and non-transferable. Please refer to the airline fare rules and conditions of carriage.

  • 6.3Domestic connections from main centres will be specified if available. Special add-on fares from other domestic points within New Zealand are available at extra cost. Please contact us if you require assistance in this regard.

  • 6.4All taxes and fees associated with the airfare (including fuel surcharges, departure taxes and government levies) are included in the package price but are subject to change without notice.

  • 6.5Subject to availability and payment of the additional costs, you may upgrade your flights. If flight upgrade payments are non-refundable we will notify you of this beforehand and as such if you cancel a package that includes an upgraded flight you will not be reimbursed for these payments.

  • 6.6 Earning Airpoints/Status points will depend on your package. Please check at time of booking.

7. Accommodation

  • 7.1 While we will do everything possible to secure your preferred room configuration request with the hotel, we are unable to guarantee these requests due to limitations on the number and types of rooms available.

  • 7.2 Hotel and facility descriptions on our website and other publications are based on information provided by suppliers and may change at any time. Pictures may not show the particular room, view, or other specifications included in your booking.

  • 7.3 Bonds or credit card imprints may be required by hotels. These are usually requested by the hotel at the time of check-in.

  • 7.4 Fortis Events will not be responsible for any costs charged by hotels due to damage caused by you, or for the return of any part of a bond payment.

8. Merchandise

  • 8.1 Where merchandise is included in your package, please ensure you select your sizes carefully as it will not be possible to exchange these items at a later date.

  • 8.2 While every effort will be made to ensure merchandise is correct, we cannot accept responsibility if the sizing does not meet your personal expectations due to the limitations of the sizes, merchandise, or styles available.

9. Event promotion

  • 9.1 The events listed on the website and any Fortis Events published materials are correct at the time of publication. If event dates are changed due to circumstances beyond the control of Fortis Events, our package inclusions and pricing may have to be altered.

  • 9.2 The tour hosts involved in our packages are at the complete discretion of Fortis Events, and you acknowledge that the people advertised as being in attendance at an event may change at short notice, or not attend if minimum group numbers are not reached.

  • 9.3 The date, time and venue of an event may change due to reasons outside our control. We are not responsible for any additional costs if such changes do not fit in with your travel and accommodation plans.

10. Our responsibilities

  • 10.1 The services that we supply consist solely of:

    • Arranging and coordinating travel, accommodation, tickets and events.

    • Making bookings and issuing tickets and itineraries to customers for the provision of services and facilities by suppliers.

  • 10.2 We undertake to perform these services in accordance with the law, with reasonable care and skill. However, we will not be held liable for any loss, damage, or claim arising from acts or defaults outside the control of Fortis Events and its employees - including (but not limited to) suppliers of travel, accommodation, and tickets in connection with your package.

  • 10.3 To the extent permitted by law, our liability to you and your party will be limited to the value of the total cost of your package.

  • 10.4 Please check all of the documentation distributed to you in relation to your travel and accommodation to ensure it fully meets your requirements. You must bring any errors to our attention at least 14 days before your travel date or we cannot guarantee the errors will be corrected to your satisfaction. Fortis Events will not accept responsibility for any documents subsequently altered without our consent.

11. Passport and visa requirements

  • 11.1 You must check passport, visa, immigration, health, and customs regulations and requirements well in advance. It is your responsibility to ensure you have the correct documentation to allow your entry overseas and/or return to New Zealand. This includes ensuring you have a current passport that is valid at least six months after you return to New Zealand.

  • 11.2 Official travel advice issued by the New Zealand Ministry of Foreign Affairs and Trade is available by visiting their website at www.safetravel.govt.nz. We recommend that you review this information both prior to making your booking and prior to departure.

12. Privacy

  • 12.1 Fortis Events is committed to protecting the privacy of the Clients in accordance with the Privacy Act 1993.

  • 12.2 In order to purchase a package from Fortis Events, you are required to provide certain personal information that is necessary to deliver the package requested. In this regard, you authorise Fortis Events to collect, retain and use personal and other information, and agree that we may disclose this information to operators (who may be third parties) for the purpose requested.  The information requested will typically include name, address, telephone number, and email address of all relevant parties.  To pay for the services you will also need to provide credit card details. Fortis Events does not retain credit card details for security reasons so they will need to be provided each time a package is purchased from Fortis Events.

  • 12.3 You have the right to access your personal information we have on file and to have it updated and corrected as necessary by contacting us.

  • 12.4 Photography and filming may take place during the delivery of your package and may capture your image. It is a condition of purchase of a Fortis Events package that you consent to use of your image for marketing purposes. If you do not wish to provide your consent under this clause 15.3, you must advise us prior to travel.

13. Accident Compensation

  • 13.1 If you are a New Zealand resident, any personal injury you suffer while overseas is likely to be covered by the Accident Compensation Act 2001. To the extent permitted by law, Fortis Events will not be responsible for any personal injury you suffer during your travels.

14. Force Majeure

  • 14.1 If we are delayed in or prevented from performing our obligations due to an event of force majeure (including, but not limited to, natural disasters, war or riots, closed or congested airports, or technical problems), then such delay or non-performance shall not be deemed a breach or entitle a claim for injury, damage, loss, delay, additional expenses or inconvenience. Our obligations shall be suspended while such event of force majeure continues.

15. Limitation of Liability

  • 15.1 Except as required by law (and to the minimum extent required by law), neither party shall be liable to the other for any indirect or consequential losses, costs or damages that arise out of or that are in connection with any duty or obligation under these terms and conditions or any duty or obligation at law.

  • 15.2 To the extent that we have any liability to you under these terms and conditions or at law, that liability shall be capped to the amount that you have paid or is payable to us in accordance with these terms and conditions.

16. Consumer Guarantees Act

  • 16.1 The Consumer Guarantees Act 1993 applies to the services we provide and nothing in these terms and conditions is intended to contract out of or limit the application of the Consumer Guarantees Act 1993.

  • 16.2 If you are entering into this Agreement in trade (as that term is defined under the Consumer Guarantees Act 1993), then we each confirm, acknowledge and agree that the goods and services are supplied to you and acquired by you in trade for a business purpose, and that the statutory guarantees and implied terms, covenants and conditions contained in the Consumer Guarantees Act 1993 are excluded to the fullest extent permitted at law, and do not apply.

17. Governing law

  • 17.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of New Zealand.

References in the above Terms & Conditions to “Fortis Events”, “us”, “we”, and “our” are to Fortis Events, and references to “you” are to you as the customer that purchases (or otherwise obtains) a travel package from us.
